Domain Name Agreement
Domain Market registers and resells top-level domain names (TLDs) - gTLDs (generic top-level domains) and ccTLDs (country-specific top-level domains).
The following Agreement ("Terms" or "Agreement") applies to your use of domain names registered through Domain Market or transferred to it ("Domain Market", "us", "our"). This Agreement forms an integral part of Domain Market’s Terms of Service and, together with the Registrar Agreement provided by the relevant Registry or registration registrar and ICANN’s Uniform Domain Name Dispute Resolution Policy (UDRP), constitutes the entire Agreement between you and Domain Market regarding the use of domain names and any domain-related Services.
Domain Market is the trading name of Aegean Host Single Member P.C. By purchasing a domain from Domain Market or transferring a domain to Domain Market, you declare that you have read, understood and agree to be bound by these Terms. The terms and conditions of our registrars may be reviewed at:
1.1. You may apply to register a domain name by submitting an order to purchase Services from Domain Market. We cannot guarantee that the domain name applied for in your Order will be registered in your name or that it can be registered by you. You should not rely on the fact that you have submitted an Order for a domain name registration until we send you notice that your Order has been accepted and your domain has been registered.
1.2. Registration and continued use of a domain name are subject to the terms and conditions of the relevant naming authority, which are incorporated herein by reference. You acknowledge and agree that Domain Market bears no liability if a naming authority refuses to register a domain name.
1.3. If you register a domain name through Domain Market or transfer a domain to Domain Market, you will be able to manage the domain through a domain management feature in your Client Area.
1.4. Domain names and any domain-related services are subject to renewal and termination as set out in Domain Market’s Terms of Service. Domain name registration and renewal fees are non-refundable in all cases. The maximum renewal period for different TLDs may vary depending on the relevant registry. Renewal fees for expired domain names may vary depending on the registry registrar.
2.1. As part of the registration process, you are required to provide us with certain information and update it promptly as required so that it remains current, complete and accurate. We will use this information in accordance with our Terms of Service and Privacy Policy. The information required to process your domain name registration is specified in your Order.
2.2. If you provide information relating to third parties, you hereby represent that you have notified those third parties and obtained their express prior consent for the disclosure and use of their information as set out in our Terms of Service and Privacy Policy.
2.3. Certain registries require you to verify your contact details after the initial registration and/or after any change of contact details before a domain name registration is completed or updated. If this applies to your domain, either Domain Market or the registry registrar will send you an email notice with instructions on how to verify your details. If you fail to verify your details within the specified deadline, your domain will be suspended or deleted, which will affect the functionality of all services related to that domain name at Domain Market. You are solely responsible for following the instructions you receive in order to keep your domain name registration in good standing.
2.4. You acknowledge and agree that upon renewal of the domain name, the type of information you are required to provide may change. If you do not agree to provide the new information, your registration will not be renewed.
2.5. The information you provide determines ownership of the domain. For non-expired domain names registered through Domain Market, and depending on the availability and requirements of the relevant registry, such information may be updated through your Client Area.
2.6. You are solely responsible for providing accurate and up-to-date contact details. We assume no liability for any cancellation or refusal to renew a domain name by the competent naming authority due to failure to provide such information. You are responsible for any changes to your domain name contact details made through Domain Market’s Client Area.
2.7. You acknowledge and agree that if (i) you provide inaccurate information, (ii) you fail to update your contact information in a timely manner, or (iii) you fail to respond to queries from Domain Market or the registrar regarding the accuracy of your domain name contact details within any specified period, this constitutes a breach of the Terms and may result in suspension and/or cancellation of your domain name registration.
3.1. By registering a domain name through Domain Market or transferring a domain to Domain Market, you understand and agree that the registry registrar, the relevant registry or ICANN may establish guidelines, limits and/or requirements regarding the information Domain Market must collect from you in order to provide you with the Services and how we may use such information.
3.2. You acknowledge and agree that Domain Market will make available the domain name registration information that you provide or that Domain Market otherwise maintains, to ICANN, the registry registrar, the registry and other third parties, as required or permitted by ICANN and applicable law.
3.3. You hereby give your express consent to the collection, use and disclosure of domain name registration information as set out in this Agreement, the Terms of Service and our Privacy Policy. You hereby irrevocably waive any and all claims and causes of action you may have arising from such use or disclosure of information by Domain Market.
4.1. You may change the registrar of record for an existing domain name in accordance with the transfer policy and requirements of the relevant Registry. Only the natural or legal person listed as the registrant in the current domain name registration (“Domain Name Holder”) may request transfer of the domain to Domain Market. By purchasing domain transfer Services from us, you hereby declare that you are the domain name holder or that you have been duly authorized by the domain name holder to initiate a transfer.
4.2. The information required to initiate a domain name transfer will be collected in the order. We may require you to provide additional documents proving ownership of a domain before or after initiating a transfer request. If the registrar of record changes simultaneously with the exchange of a domain name from one party to another, we may also require you to provide appropriate transfer authorization - namely a bilateral agreement between the parties, a final decision of a binding dispute resolution body, a court decision or other appropriate authorization.
4.3. Upon successful completion of the registrar transfer request, our registrar will immediately become the registrar of record.
4.4. You acknowledge and agree that any domain name transfer is subject to the terms and conditions established by the relevant Registry. Domain Market bears no liability for the transfer of domains that do not meet the transfer requirements of the relevant Registry.
5.1. If stated in your order, and subject to availability, we will provide you with private domain name registration services (ID Protect). If we provide you with ID Protect services, you acknowledge and agree that the Service is extended to you as provided by the relevant Registrar and Domain Market bears no liability if your identity is accidentally disclosed.
5.2. By purchasing ID Protect services from us, you agree that (i) your use of the Services must comply with the terms and conditions set out in the Terms of Service, (ii) you are responsible for maintaining accurate and up-to-date domain name contact details, (iii) you must not use the Services in order to circumvent any legal requirement or registry, ICANN or other requirement or regulation, and (iv) you must promptly respond to any notice that we or the domain name registrar may forward to you as a result of your use of ID Protect Services.
6.1. If you purchase domain name Services from Domain Market, the domain name will be associated with your Customer Account and you will be solely responsible for managing the domain in full compliance with this Agreement and the Terms of Service even if the domain is registered to or belongs to third parties.
6.2. Any dispute between you and any third party regarding a domain name must be resolved between the involved parties. Domain Market will not be a party to a dispute, nor will it facilitate resolution of the dispute. We reserve the right, once we become aware of a dispute and at our discretion, to suspend or cancel the domain name and/or make the appropriate representations to the registrar or relevant registry. You warrant and represent that, to the best of your knowledge and belief, neither the registration of the domain name nor the manner in which it is used directly or indirectly by you and/or any of your affiliates infringes directly or indirectly the lawful rights of third parties. In all cases, disputes regarding ownership of domain names are governed by ICANN’s UDRP, which forms an integral part of this Agreement.
