1. Scope of the service
Email Marketing provides tools for creating and sending campaigns, managing contacts, lists and segments, automations, signup forms, analytics and sender authentication, and, where available, AI Newsletter Creator, AI Image Generation and a personal Media Library.
Prohibition on newsletters and advertising emails — indefinite suspension
Using any Domain Market plan or service, whether free or paid, to send newsletters, advertising emails or promotional emails is expressly prohibited, with Email Marketing plans as the sole exception. This prohibition applies regardless of recipient count, sending frequency or recipient consent and covers all sending methods, including SMTP, webmail, scripts, applications, CMS plugins and automations.
These messages may be sent exclusively through the sending infrastructure of an Email Marketing plan, subject to its specific terms, plan limits and the Acceptable Use Policy. Holding an Email Marketing plan does not permit using another plan or service for these messages.
Any service account found to have been used to send messages in breach of this prohibition will be suspended indefinitely, with no possibility of lifting the suspension, reactivating the account or restoring it to operation. Subsequently stopping the messages or removing the relevant software or recipient lists does not lift the suspension.
2. Contacts and lawful basis
The Customer is solely responsible for having a lawful basis for every contact they import or use. They must be able to demonstrate consent or another lawful basis where required by the GDPR, ePrivacy rules and applicable law.
Purchased, scraped, harvested or otherwise unlawfully obtained lists are prohibited, as is sending to recipients where the Customer cannot substantiate a lawful right to contact them.
3. Unsubscribing and suppression
Every marketing email must include a working unsubscribe mechanism where required. Recipients who have unsubscribed, complained or been suppressed must not be reactivated without a new, valid lawful basis.
The platform may retain suppression data to prevent messages from being sent again inadvertently.
4. Sender identity and authentication
The Customer may use only sender names, addresses and domains they are entitled to use. Domain or email verification and SPF, DKIM and/or DMARC configuration may be required.
Impersonation, spoofing, phishing and misleading sender identities are prohibited.
5. Deliverability
Domain Market provides the platform and sending infrastructure but does not guarantee inbox placement or particular open, click or conversion rates. Delivery depends on reputation, content, authentication, engagement, bounce and complaint rates, and third-party providers’ policies.
6. Bounces, complaints and abuse thresholds
High hard-bounce, complaint, unsubscribe or spam-trap rates may lead to temporary restrictions, a verification review, a requirement to clean the list or suspension of sending to protect the shared infrastructure and its reputation.
7. Plan limits
Contact allowances, monthly sends, automations, users and other limits are those specified in the Order and the Custom Client Area. When a limit is reached, the relevant function may be restricted until the next billing period or an upgrade.
8. Campaign content
The Customer is responsible for the accuracy and lawfulness of content, including commercial claims, offers, images, links, trademarks, copyright and all other material.
9. AI Newsletter Creator
AI Newsletter Creator may suggest subject lines, preheaders, copy, calls to action and content blocks. Its output is a draft that the Customer must review and approve before sending. Domain Market does not guarantee the accuracy, lawfulness or suitability of AI-generated content.
10. AI Image Generation
The Customer must review AI-generated images before using them. They are responsible for ensuring that prompts and outputs are not used in ways that violate the law, third-party rights or service policies.
11. Media Library
The personal Media Library stores assets belonging to the Customer’s business. The Customer confirms that they have the right to use the material they upload.
12. Automations and scheduling
The Customer is responsible for triggers, audiences, scheduling, time zones, conditional flows and the final outcome of automations. The platform does not guarantee that third-party events or integrations will always arrive on time.
13. Personal data
For contact and campaign data, the Customer is generally the controller and Domain Market the processor under the DPA. The Customer must maintain consent records, privacy notices and retention rules.
14. Import, export and data quality
The Customer is responsible for import accuracy, field mapping, duplicates and data hygiene. Before a bulk import, they must ensure that the list is lawful and active.
15. Suspension
Domain Market may immediately restrict or suspend campaigns in cases of spam, phishing, malware, abnormal complaint or bounce rates, AUP breaches, risks to reputation or a lawful order.
16. Data retention
Following expiry or cancellation, contacts, campaigns, templates, analytics and media may be deleted after the applicable retention period. The Customer must export anything they need before the service ends.
17. Guarantees and refunds
The 100-day guarantee applies only if expressly included in the particular paid offer or Order. Third-party charges or consumed non-refundable services are excluded where provided for.
18. White-label and branding
Where white-label or branded features are provided, the Customer remains responsible for their brand, content and the lawfulness of their messages.
